Terms and Conditions of Sale

The owner of the e-shop E-shop Helmetshop and MXshop (hereinafter the Online Shop) is Good Plan OÜ (registration code 11932445), located in Tallinn.

  1. VALIDITY OF THE SALES AGREEMENT, PRODUCT AND PRICE INFORMATION
    1. The terms and conditions of sale apply to the purchase of goods from the Online Shop. The prices of the products sold on  are given in euro and do not include delivery costs.
    2. The prices of the products sold in the online shop are indicated with the products. The price is subject to a delivery charge, with the exception of promotions during which  will deliver the goods free of charge.

  2. ORDER FORMATION
    1. To order the goods, you must add the desired products to the shopping cart. To complete the order, you must fill in the required data fields and select the appropriate method of product delivery. The amount of the fee will then be displayed on the screen, which can be paid via a bank link or bank transfer.
    2. The contract enters into force from the receipt of the amount to be paid to the online store’s current account.
    3. If the ordered goods cannot be delivered due to the end of the goods or for some other reason, the buyer will be informed of this as soon as possible and the money paid (including the costs of delivering the goods) will be returned without delay, but no later than within 14 days of sending the notice.
  3. DELIVERY / TRANSPORT
    1. The goods are sent within Estonia to a suitable parcel terminal chosen by the customer.
    2. Shipping costs are borne by the buyer, if the order amount is less than €50, the corresponding shipping cost is displayed in the shopping cart.
    3. Orders placed and paid Mon-Fri before 13:00 will be shipped the same day or within 1 business day at the latest.
    4. Domestic shipments generally reach the destination specified by the buyer within 1-3 business days after the purchase. In exceptional cases, you have the right to deliver the goods within 4-5 calendar days
    5. The online store is not responsible for delays in the delivery of goods if the goods have been handed over to the logistics partners. The online store could not influence or foresee this.

  4. RIGHT OF WITHDRAWAL / EXCHANGE
    1. After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days.
    2. The right of withdrawal does not apply if the buyer is a legal entity.
    3. In order to use the 14-day right of return, the ordered goods must not be used in any other way than is necessary to make sure of the nature, characteristics and functioning of the goods in the way that it is allowed for inspection. 
    4. The right of withdrawal cannot be exercised if the consumer has already used the product, tried it with a finger, removed the protective film-labels from the product or opened the package, which means that it can no longer be offered to third parties for health protection or hygiene reasons. 
    5. In order to return the goods, you must notify us of your wish to withdraw by sending an email to info@mxshop.ee or info@helmetshop.ee no later than 14 days after receipt of the goods.
    6. The cost of returning the goods is borne by the buyer, unless the reason for the return lies in the fact that the item to be returned does not correspond to what was ordered (e.g. a wrong or defective item).
    7. The buyer must return the goods within 14 days after submitting the application or provide proof that he has handed over the goods to the carrier of the goods within the aforementioned period.
    8. Upon receiving the returned goods, the online store will return them to the buyer immediately, but no later than 14 days after receiving the withdrawal request, excluding transport costs.
    9. The Online Store may refuse to issue refunds until it has received the item that is the subject of the contract or until the buyer has provided evidence that it has returned the item, whichever occurs first.
    10. If the buyer has explicitly chosen a delivery method other than the cheapest usual delivery method offered by the Online Store, the Online Store does not have to refund the cost to the consumer that exceeds the cost associated with the usual delivery method.
    11. The online store has the right to withdraw from the sales transaction and demand the goods back from the buyer, if the price of the goods in the online store is marked significantly lower than the market price of the goods due to an error.
    12. If the goods are too big or too small, the buyer has the right to exchange the goods  for another size within 30 days free of charge. The transport costs of the exchange are to be paid by the buyer.
    13. If the buyer wishes to exchange the goods for a cheaper product and the price of the new  product is less than 50eur, the initial shipping cost of the goods must be paid.
    14.  For hygienic reasons, motorcycle helmets must always be tried on with the disposable face mask that comes with the helmet. Otherwise, the product cannot be returned or exchanged.
  5. RIGHT TO MAKE A CLAIM
    1. The online store is responsible for the non-compliance of the goods sold to the buyer with the contract conditions or a defect that already existed at the time of handing over the item and that appears within two years from the handing over of the goods to the buyer. within the first six months from the delivery of the item to the buyer, it is assumed that the defect already existed at the time of delivery of the item.     2. In the event of a defect, the purchaser has the right to contact the online shop within two months at the latest by sending an e-mail to info@mxshop.ee or info@helmetshop.ee or by calling +372 58 303 131.
    3. The online store is not responsible for defects that have occurred after the goods have been handed over to the buyer.
    4. If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Webshop will return all fees associated with the sales contract to the buyer.
    5. The online store responds to the consumer’s complaint in writing or in a form that enables written reproduction within 15 days.
  6. PERSONAL DATA PROCESSING
    1. The online store uses the personal data entered by the buyer (including name, phone number, e-mail address, bank details) only to process the order and send the goods to the buyer. The online store transmits personal data to companies providing transport services in order to deliver the goods.
  7. RESOLUTION OF DISPUTES
    1. If the buyer has any complaints regarding the Online Shop, they should be sent by e-mail to info@mxshop.ee or by telephone to +372 58 303 131.
    2. If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can appeal to the Consumer Disputes Committee. You can familiarize yourself with the procedural conditions and submit an application on the website of the Consumer Protection Board. The competence of the Consumer Disputes Committee is to resolve disputes arising from the contract concluded between the buyer and the Online Store. Review of the buyer’s complaint by the commission is free of charge.
  8. COPYRIGHT
    1. The Helmetshop and MXshop brand belongs to Good Plan OÜ.
    2. The design, images, photos and texts of the Website and Online Store are protected by copyright and the exclusive right to use it belongs to Good Plan OÜ. The content of the website may not be reproduced, distributed or modified without the written permission of Good Plan OÜ.
